01Service owner

The Arena Bragis service and its “Punto de Encuentro” product (the “Service”) are offered by [NOMBRE COMPLETO], a natural person resident in Colombia, holder of Colombian citizenship card (cédula de ciudadanía) No. [CÉDULA], with mailing address at [DIRECCIÓN DE CORRESPONDENCIA, CIUDAD, COLOMBIA] and telephone [TELÉFONO]. In these Terms, “we” means the owner of the Service and “you” or “the streamer” means the person using it.

Contact: info@arenabragis.com. Privacy and data protection: privacidad@arenabragis.com.

02Purpose and description of the Service

The Service is a web platform for Twitch streamers. The streamer signs in with their Twitch account (OAuth), enables optional interactions and adds to OBS a browser source with a 1920 × 160 pixel pixel-art overlay. The available interactions are:

  • Chat commands from a closed list (!entrar, !saludar, !bailar, !aportar).
  • Cheers with Bits.
  • Channel points reward redemptions.
  • Subscriptions, resubscriptions and gift subscriptions.

Viewers who take part appear on the overlay as avatars with their public Twitch display name. Free chat text is never shown on the overlay. Every interaction starts disabled and the streamer decides which ones to enable.

03Acceptance and requirements

To use the Service you must accept these Terms and the Personal Data Processing and Privacy Policy when connecting your channel. We record the accepted version and the date and time of acceptance. Acceptance by electronic means is fully valid under Colombia's Law 527 of 1999.

You represent and warrant that:

  • You are at least 18 years old and have the legal capacity to enter into this agreement.
  • You are the owner of the Twitch channel you connect, or an administrator expressly authorized by its owner.
  • The information you give us is accurate and you will keep it up to date.

04Free beta, “as is” and with no availability commitment

The Service is in beta and free of charge: there are no paid plans and no billing. It is provided “as is” and “as available”, without a service level agreement (SLA). It may contain errors, interruptions or functional changes, and we may modify, limit or withdraw features during the beta.

If paid features are introduced in the future, we will tell you in advance and you will only be charged if you expressly accept them under separate terms.

05Account, Twitch connection and security

  • Your account is created and identified through your Twitch account. We only request the scopes the available interactions need.
  • The OBS overlay URL contains a secret key. Treat it like a password: do not show it on stream or share it. If you think it has leaked, rotate it from the panel; the old one stops working immediately.
  • You are responsible for activity carried out from your session and must tell us without delay about any unauthorized use.

06Streamer obligations

  • Comply with the Twitch Terms of Service and the Twitch Community Guidelines, as well as the law applicable to your broadcasts.
  • Tell your audience that the channel uses Arena Bragis and how they can exercise their rights. The Privacy Policy includes a ready-to-paste text for a panel or your channel description.
  • Configure interaction rules responsibly and moderate your community with Twitch's tools.
  • Take responsibility for the content of your broadcasts and for reward names or other texts you configure.

07Acceptable use

You may not:

  • Use the Service to harass, discriminate against or impersonate others, or to spread content that is unlawful in Colombia or contrary to Twitch's rules.
  • Generate artificial events, abusively automate interactions or circumvent the Service's limits, cooldowns and quotas.
  • Attempt to access other users' data or channels, probe for vulnerabilities without authorization or interfere with the operation of the Service.
  • Reverse engineer, decompile or disassemble the Service, except to the extent the law expressly allows it.
  • Resell, sublicense or commercially exploit the Service as such, or embed it in other products without our authorization.

08Intellectual property

The software, designs, texts, the “Arena Bragis” and “Punto de Encuentro” marks and the Service's art belong to the owner or its licensors. Part of the pixel art is third-party work used under a commercial licence.

While you use the Service in accordance with these Terms, we grant you a non-exclusive, non-transferable, revocable, royalty-free right to show the overlay in your broadcasts and in recordings or clips of those broadcasts. This right does not include extracting, downloading, copying, modifying or separately reusing the sprites, backgrounds or other graphic or sound assets.

If you send us suggestions or feedback, we may use them to improve the Service with no obligation to compensate you. Twitch, Bits and the other Twitch marks belong to Twitch Interactive, Inc.

09Personal data

The processing of streamer, viewer and visitor data is governed by the Personal Data Processing and Privacy Policy and the use of cookies by the Cookie Policy, both of which form part of these Terms.

10Suspension and termination

We may suspend or terminate an account's access, or disable a channel's overlay, when it breaches these Terms or Twitch's rules, when necessary to protect other people or the security of the Service, or when required by an authority. Whenever possible and without compromising security, we will give you prior notice stating the reason.

We may also end the beta or the Service. In that case we will give at least 30 days' notice in the panel or through the available contact channels, except in cases of force majeure, and we will delete data in accordance with the Privacy Policy.

11Deleting your account

  • You can delete your account at any time from the panel. Beforehand, if you wish, you can export your data as JSON.
  • Revoking Arena Bragis's access in Twitch (Settings → Connections) also deletes your account and the linked data automatically.
  • Accounts that need to reconnect to Twitch and have no session for 180 days are deleted.
  • When an account is deleted, everything linked to the channel, including the overlay crew, is erased immediately and the tokens are revoked at Twitch. The overlay URL stops working.

12Limitation of liability

Within the limits allowed by Colombia's Law 1480 of 2011 (Consumer Statute) and other applicable rules, and bearing in mind that the Service is a free beta:

  • We are not liable for interruptions, delays or failures caused by Twitch, OBS, hosting providers, internet connectivity or other third parties beyond our reasonable control.
  • We are not liable for the content of broadcasts, the conduct of viewers or decisions Twitch makes about your channel.
  • We are not liable for lost profits or loss of revenue, audience or opportunities arising from the use of, or inability to use, the Service.

Nothing in these Terms excludes or limits liability for wilful misconduct or gross negligence, or any consumer rights that cannot be waived under the law.

13Changes to the Service and these Terms

We may amend these Terms to reflect changes to the Service or the law. Each version will be published on this page with its effective date. We will announce changes in the panel and ask you to accept the new version before you continue using the Service. If you do not accept it, you can delete your account at any time.

14Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Colombia. Any dispute will be submitted to the competent courts of Colombia, without prejudice to your rights as a consumer, including the option of turning to the Superintendence of Industry and Commerce, or to any mandatory consumer protection rules of your country of residence that may apply.

The Spanish version of these Terms is the only legally binding one; translations are provided for information only.

15General provisions

  • If any clause is held void or unenforceable, the rest remain in force.
  • Not exercising a right at a given time does not mean waiving it.
  • Communications about the Service may be made electronically: notices in the panel or e-mail.
